Chevron Texaco Finally Realizes the Perils of a Godless Nation with NO Rule of Law

August 19, 2009  We at ECrisis commend Chevron Texaco for the essentials of stating its case, delivering the facts about the current lawsuit against their corporation. Although the governmentally-owned state oil slush fund called PetroEcuador has never once factually stated the facts, comes now the aggrieved party-Chevron- to so do for reasons that never should have occurred.
 
Chevron Texaco suffers a law suit that is entirely different in every way from the law suit originally filed inside Ecuador in the 1990s. Not only has the case and its claim mysteriously been altered but the entire matter today is in as stark a difference between the claims as is night and day. We believe this is an appropriate distinction which has real bearing on this case and cannot lead any reasonably informed person to find value in the Ecuadorean legal case against Chevron Texaco.
The case must be dismissed.
 
For our part, we have some real problems with Chevron Texaco which it really needs to clear up. Indeed, with no independent forensic audit of PetroEcuador, there is only a movable feast of sloppy so called defense proofs which makes a lot of money for the local Ecuadorean lawyers but never once cut to the essential facts of the matter. With no basic discovery principles in play, no independent data and absolutely no facts about the failure of the state of Ecuador to protect and defend any juridical precept of rule of law, Chevron Texaco failed itself in preparing to counter the lies, the specious claims against the company and the utter collapse of any honest, verifiable plaintiff claim brought against the company. The entire case, if one could call it that, moved and moved and moved from pillar to post while the nation's integrity collapsed and its commitment to sound legal practices clearly was expunged. Was this Chevron's fault-? No. This is the fault of the Correa government whose constitution of September, 2008 opened the door for non-justice and a full state commitment to complete practices in theory- now born out- that the state has and holds its perceived right to act as a provocateur in its own dishonesty, its disgrace and its malfunction, such as we see in the Chevron matter.

Chevron Texaco's crime, if one could call it that, was to fail itself in stating the conditions inside Ecuador. No doubt its own legal team assumed it could work within the precepts of the non-functioning Correa state when of course no one and nothing can. Ecuador is clearly a dying nation whose judicial system, as all state functions, is fully controlled by the Correa cartel and this alone denies justice.
 
That Chevron Texaco cannot bring itself to state the facts of the panoply of factors which it is up against, is irresponsible. But the real crime remains the crime of false accusations, non-facts and a full array of charges against this company which are baseless and indeed remain the worst sort of slander. The government of Ecuador is indeed party to the lawsuit against Chevron Texaco in everyway now....and not just politically. Worse yet is the Correa regime's commitment to hiding PetroEcuador's cozy, statist burglary and addiction to blaming PetroEcuador with no fault while passing all state faults off on to Chevron whose fault none of this remains. But it has taken Chevron Texaco far far too long to come to its senses and start to tell the truth. That they do so now is laudable but indeed now costly. Had Chevron Texaco stopped pretending that the government of the United States of America- viz the State Department- remains correct and that the nation of Ecuador is an ALBA nation committed to absolutely no rule of law in all that they do- and we do mean all that they do- the framework of the entire matter would be more speedily expedited. but no- Chevron wanted to defend itself not and rely on some of the most arrogant and sloppy defense tactics known to man: that as with all Ecuadoreans, if one pretends that nothing is wrong, no problems arise. Problems rose up for Chevron Texaco all right and no one could have missed the arrival. $30 billion worth of problems, all specious charges against the company and the matter is not settled yet.
 
To be sure, the USA's Barack Hussein Obama administration claims to revere Rafael Correa for all the wrong and dishonest reasons. Like all Ecuadoreans, Obama's team pretends that Correa is an American educated economist and therefore he surely must be honest. This is wrong on both counts. Correa's cheesy 18 month combine shopping mall Masters and PhD thesis is a disgrace and reveals that he is not educated at all. His thesis sets about to prove how Marxism serves mankind best and that the NAFTA treaty has caused economic harm to Mexico. Correa's data was....early 1992 data. Of course NAFTA was in play after 1995 with functional data post 1996. Clearly Correa has a history of jiggering the facts whenever it suits him. We wager that had none turned a blind eye to his ridiculous non-scholarship, we would not be having this discussion today. But the point is that Correa has made a career about lying and manipulating. And above all, Correa has a decades-long love affair with Fidel Castro, with Cuban Marxism and with the lowest vermin that has crawled on this Earth. Why Obama calls Correa a good friend and close ally of the USA remains... a dysfunctional deceit on many levels, misrepresenting the intent of the American people who do not want to join Obama in bed with every Tom, Dick and Harry who are dishonest boobs and liars such as communists Chavez, Castro and Correa.
 
It is impossibly irresponsible to go up against a government named Ecuador that refuses to practice honesty and it is past pathetic- it is debilitating-  to pretend that the USA's protection of the drug king pin Correa will bring forward Chevron's justice.
 
Willfully ignoring the machine now moving- the dual elements of fake protagonists and the government of Ecuador and its backer, the government of the USA lays down a horrifying wall of deceit which Chevron must now scale. It did not have to be this way.
 
Chevron's crime is an essential error in judgment, corrected today only because its own U.S. citizens- its shareholders refuse to go quietly in to the night of yet another U.S. government and Ecuadorean governmental-backed bankruptcy. The citizen shareholders actually want Chevron to succeed. We commend this attitude and share this. Thousands of jobs will be lost because of the dual nature of the so called plaintiffs' presentation against Chevron- a snatch and grab for no reason whatsoever of $30 billion which of course is based on lies.
 
The USA's president has a serious hand in this legal fraud against Chevron. He is a fellow traveler of Stephen Donziger, lead lawyer for almost 20 years in the unending series of movable lies about Chevron.  Obama, as Senator, detailed his support for the Donziger-Correa claims against Chevron. He has neither distanced nor denounced his support....and he should. Indeed, Obama's dishonest support for Correa led numerous men from Correa's inner circle team leaders to claim in Ecuadorean media that U.S. Congresswoman Ros-Lehtinen's recent comments about the dire necessity for a factual review of Correa and his FARC machinations meant nothing because a) she is a woman and b) she is a Republican and besides, as they soothed, all Ecuadoreans know that Obama loves Correa and will protect them from the Republicans whose only cry is indeed a correct one- transparency, accountability and fair play. Obama and his team will have none of that because they have cast their lot with Chavez, Correa, Zelaya, Ortega and ultimately the harm- real harm- being done to a US corporate entity while avoiding all facts.
 
This is not unlike the specious pretext that Honduran Zelaya was illegally ousted when of course any fact based review concludes that Obama and his team are grossly, deeply wrong in their relationship to Zelaya and his removal. But struggle Obama and Dan Restrepo do against all odds and against the facts.

Chevron Texaco failed itself to determine the real plaintiffs in this case which are empowered through their high offices to lie and manipulate when indeed this must be stopped. Obama's real and perceived support against Chevron is a cancer that destroys even handed justice and must end now. That Chevron fails itself to privately end this assault on its own entity is pathetic. Its shareholders ask if the company is doing all that it can to defend them from specious, slanderous lies and law suits. The answer is clearly- no and the shareholders deserve better.
 
Chevron Texaco  is afraid to ask who all is funding these wild eyed claims against them. Chevron is afraid to determine how many thousands of paid US State Department activists flood across Ecuador funded by the US taxpayer, all in lock step to protect and defend Correa's ALBA and FARC ménage a trois of criminal corruption because, as they incorrectly lie, Correa is just helping the poor. Correa is not helping the poor and he has debased all integrity.
 
Know your opposition. Know the facts. Know what you are up against. Chevron irresponsibly acted just like Ecuadoreans and stubbornly refused to do this for almost 15 years and this has cost them not only prestige but a lot of money. Chevron refused to determine the machine of disgrace that they were pitted against- a machine that did not exist until it grew to formal proportions by 2005- 2006 and is now completely unhinged, a nation floundering in duplicity.
 
Chevron Texaco mistakenly retained some of the stupidest counsel and lobbyists on the face of this Earth for its helpers. Chevron believed that by ignoring the essentials of any case, any claim and the shuttering of Ecuadorean democracy that it could somehow win the day is beyond the crime of throwing good money after bad ends. It has been losing until lately. But if Chevron Texaco seizes the day and saves its company, it will only be because it has deemed it prudent to act with honor, act responsibly and defend its truths. In this, we believe, lies success. Good luck however with Obama and Correa, both of whom will be gone in less than 4 years. But Chevron will have no justice at all in Ecuador.
 
To be sure, the U.S. Department of State, which helped fund and enact the ALBA constitution of 9-08 pretends that the non-democracy and the legalization of all that should never be legalized makes no difference. We remind that it does make a difference and as such, State Department's willful blind eye is now called complicity in crafting an illegal cartel state. If one could, one should sue State Department for lying to companies all over the world, leading them down a happy path in Ecuador based on lies. But no sane businessman regards State Department as honest anyway and no one with half a brain goes to the US Department of State or its embassies because they know that these offices are going to lie to them anyway. Not one- not one- unpaid, unmanipulated soul is welcome from these so called diplomats. And please....do not tell us about the fabulous bought and paid for propagandists, liars and schlubbs from the Ecuadorean-American Chamber of Commerce. They have been growing their dishonesty since 2001 and it is now total and irrevocably criminally dishonest.
 
There are no truth tellers in Ecuador any more. All have been extorted by the Correa regime- threatened, lied to , seduced, abused or thrown in jail or run out with businesses seized for specious grounds. And if you concur with this, then you must ask why o why Chevron even dreamed that it could have a fair shake in Ecuador's courts? And why o why Obama calls Correa an ally and friend when Correa is a prince of drug runners, terrorists and vast duplicity which has destroyed Ecuador and turned it in to a narcostate. Chevron will never have justice in a narco state but....Chevron refuses to review just what that framework of criminality remains. We wish them good luck on that.
 
But Chevron Texaco cared not one whit over its 15 years of legal wrangling that the nation of Ecuador was losing any rule of law. It cared nothing. It said nothing and it remained convinced that its own fabulous Ecuadorean lawyers could out manipulate a serious sociopathic manipulator, Correa. This utter foolishness has taken on Biblical proportions for time and money wasted. Chevron's own denial of due diligence is pathetic and its self defense was pathetic. But like South Africa's phalarope, it may be too late for Chevron to grasp the concept that by arrogantly pretending that democracy matters not, the essentials of rule of law and accountability matters not that it too could game justice, we are appalled and duly say today that Chevron helped not its own and helped no one in Ecuador, except to remediate correctly many open pits. But it forgot to tell the story and it forgot to act responsibly- failing to analyze the non-state of the Correa state, pretending that rule of law mattered nothing as long as Chevron got theirs. It matters a lot. Just as all others were denied rule of law in Ecuador, now too Chevron is denied rule of law. In all things, Correa is an equal opportunity criminal. But as stewards, Chevron comes awfully late to this matter and still yet refuses to complete the needed cycle to win and end this ridiculous lawsuit- $30 billion and more- against its own.
 
The U.S. Department of State must deliver a full faith and warranty statement that the President of the United States withdraws his previous formal support for the Correa -Donziger law suit. This is an essential and can be easily done now. We say this because the Correa team of liars uses this one document to extort and control its own judges, as our readers know. Obama and Clinton are responsible for revoking past statements by Obama and ending this merry go round of extortionists.
 
For its part, Chevron Texaco is said to have revamped its legal teams. If so, we say bravo. We do note that its chief counsel is also under serious attack by the Obama team over specious grounds as well- the claim that he committed criminal acts while working through the Bush administration. Chevron Texaco, in its unending support for the ruinous Obama team of liars, hurts itself when it fails to grasp how deeply entrenched is the entire Obama inner circle to charge the "Bush group" with crimes they never committed. Obama's money man and personal Rasputin funded Spain's Balthazar Garson to prepare his phony legal claims against the Bush group and does now yet proceed because there is no quit claim there either. Know your adversaries. Know what you are up against and prepare accordingly.

Chevron faces a nation of drug runners where no truth, no free speech and no open media is permitted. No private business is not either taken by the state or controlled by bribes and extortion. There is no justice. Their constitiution is a legalizers' dream. Correa needs to go and take his failed cartel with him.... to Guantanamo prison.
 
There is no justice- no justice at all for Chevron Texaco in Ecuador. The sooner that Barack Hussein Obama grasps this concept is the sooner that even handed law and order can start to be reinstated. But there will be no restitution of democracy in Ecuador as long as Clinton's minions of mayhem and Obama's conferred bleassings on the proxy of the Russo- Iranian nexus proceeds unabated. Chevron needs to comprehend its adversaries and say in one voice- we will not suffer because no one wants to be honest about the cess pool that is Ecuador. Enabling crime whether by silence or by complicity is still enabling crime.
 
. Who has been paying Donziger all these years? It is not his so called non profit. It is not his law firm. Chevron has a need to know.

. When will Chevron have removed/voided the Donziger-obtained support letter by then Senator Obama which Ecuadoreans still hold as "proof" that Obama will jigger justice for Correa's cartel?

. When will a full forensic audit of PetroEcuador be completed and attendant Dossier of US tax dollars abused to  promote and expand Correa's cartel?

. When will the US taxpayers know that Chevron is pitted in a land where post 2005 there is no rule of law, no justice at all even though the US taxpayer is spending tens and tens of millions to deliver rule of law in Ecuador when in fact fraudulently, the US taxpayer is defrauded even as their own money is spent on expanding no rule of law whatsoever and building lawless cartels which they call wonderful?
 
Because the USA refused to cleanup its own mess- still beavering away to destabilize Ecuador by selling its special politics of hatred- in Quito, Chevron waltzed in to a false setting, a world turned upside down as all is dishonest and manipulated. The USA lied so much that Ecuador exercised rule of law that Chevron walked in to a lie, perpetrated by the USA abusing US tax dollars. There is no rule of law in Ecuador since 2005. There is a cheap cartel government under Correa now, fully operational and chock full of some of the worst liars, cheats, burglars and propagandists on Earth.
 
When a government lies to its people assiduously, that country is drifting to war. Today Ecuador is at war with itself. Not with tanks or bombs but with a demon far worse- its very soul and its soul has easily been seduced and bought out by Correa and Hugo Chavez- liars all. Correa, who is a drug king pin, has synthetically destabilized the region by his addiction to Marxism and utter dishonesty. He is no friend to anyone and certainly is not, contrary to Obama’s dishonest claim, an ally of the USA. Correa hurts Americans as fast as he can. Correa and his family of drug runners have no regard whatsoever for US laws and norms. We do not know why his mother lives in the USA because she has no regard nor respect whatsoever for US norms. Just look how she raised her son- to hate the USA because the USA correctly imprisoned Correa's father as a nasty drug runner. Sra. Correa is in the USA to launder and deceive. She needs to be sent back now. She should enjoy the fruits of her little boy's work- the end of hope, the rejection of integrity and the denouncement of fair play. She created this monster and she should end her ciminal enabling of Rafaelito.

All narcissistic sociopaths, like Correa and Chavez, eventually do not exercise common sense because they are empowered to retain power, as is the case today. Sooner or later all will stop laughing at Chavez and Correa and take seriously the profound ramifications of what we do here now.

"...without God, a nation cannot build its future..., ...since man is not capable of managing his own future without counting on those elements that have God as their beginning and fulfillment...."

ECrisis has long pointed out the folly of deception and manipulation.

Today we point out that under Correa and his ALBA constitution, we see that:

1. Ecuador is not a democracy- Ecuador has no democracy- has none of its ingredients and is a fake democracy

2. Ecuador has no transparency and accountability by its own choice. Ecuador is a fake economy even as Correa either steals outright other people's businesses or extorts and bribes what few remain

3. Ecuador has a new fake state religion of a goddess that Correa claims existed before the Incas. That too is a lie as Pachamama was created whole cloth by CHE! loving new age idiots.

4. Ecuador has no rule of law- only Correa's dictatorial whims. There is no justice on Ecuador for anyone

5. Ecuador has closed free speech and open media for all intents and purposes. Correa's cartel is determined to control what you say and when. There is no freedom in Ecuador- only manipulative living in the bedrock of dishonesty.

6. Ecuador's dishonest criminal Marxist-communist president is a drug king pin who has inserted a lawless cartel bloc where once a nascent republic stood.

It is time to state the facts. The Chevron Texaco presentation begins to do so. It is not complete but, although contrary to the ridiculous lies spewed by the government of Ecuador in lock step with the ridiculous lies spewed by the government of the United States about Ecuador, it at least begins. Belatedly but we give high marks for even beginning. Stand up Ecuadorians and ask for the facts. It is a good place to start.
