There is No Justice in Ecuador Anymore

August 21, 2009 ECrisis has long heralded the common problems of Ecuador- today manifest in the fake law suit created on lies, greed and no facts by so called environmentalists but is in fact a sweeping extortionist testament by and crafted to monetarily reward a handful of U.S. trial attorneys and the government of Correa's  Ecuador for $30 billion against Chevron Texaco's corporation for crimes it never committed. This stunning rejection of truth telling about the USA by the USA has enabled a gross series of miss steps, currently alive and swelling. We wish Chevron all the best in getting its facts out and we commend their steps to do so. They are late in this and the tide is high- against them. That Correa-Donziger law suit should not exist because Chevron Texaco committed no crimes and the law suit before Ecuador's courts should not be inside Ecuador at all because the law against Chevron today is counter to the essential legal norm of forum non conveniens.
 
Chevron Texaco for too long, and indeed in this radio presentation, failed itself and failed all who are currently being extorted by Correa's racketeering nation, to stand for essential facts. This is past disappointing although we are thrilled that Chevron's legal counsel exposes themselves as utterly worthless and easily rejected by future clients who might in fact want to win and not face bankruptcy as is the case here. We do not want to put too fine a hand on all this because we applaud Chevron for stating its facts in a place and time where its truths have long been relegated to the realm of the unpopular, albeit correct.

We at ECrisis listened intently to the Fausta-Robertson radio interview. We are delighted that Fausta interviewed Chevron's Robertson and commend both for their informed discussion. Robertson's comments are correct- especially about the matter of retroactive environmental laws which were not in existence before 1999-2000 and of course remain as  illegal to retrofit environmental laws to a time and a place when the newer "environmental" laws were not in place. Robertson forgets to grasp the concept of how and when Texaco was booted out of Ecuador- this was a time of Rodrigo Borja who was a socialist-Marxist who consolidated Petroecuador and revoked all operators outside the state oil machine. Rodrigo Borja's family today is involved with Hugo Chavez's government in many ways- none of them good. The USA itself detested the Rodrigo Borja government of corrupt state Marxism and had the guts to so say in those years. One does well to state the facts. He also forgets that it took Duran-Ballen to re open Ecuador to competition and additional players...which, after the passage of the BIT and patent protections, more DFI poured in... saving Ecuador from economic collapse which of course today Correa is determined to perforce. For the past many years, the rejection of accountability and transparency has seen the government of Ecuador enjoy a precipitous loss of jobs, income and... its legitimate future, leaving illegitimate business, all controlled by Correa's hands.

Roberston says that an outside-of- Ecuador NGO, headed by Obama's friend and fellow traveller-lawyer Donziger, will end up being the 1/3 beneficiary- the American Trial Lawyers- [$10 billion] if the case wins against Texaco in Ecuador. The speaker also said that Chevron's lawyers in Ecuador suffer intimidation, threats and denial of due process. These lawyers are hiding in Miami right now- or so  we have read in the media.  Fausta notes that Correa is helping the plaintiffs and hosting press conferences. Kent says that three high judges are ousted in Ecuador if they rule in favor of outsiders. It should be repeated all the many events that Speaker of the US House Nancy Pelosi and her close chum Cong. McGovern have gifted to  the Correa government- the press conferences, the fake propaganda, the hundreds of US paid employees who assist the so called plaintiffs in lying a lot about the Chevron case and the utter crime of installing the 9-08 constitution in Ecuador just because these so called US Democrats actually believe that the Correa-Chavez ALBA constitutions which legalizes all crime and removes all tenants of normative governance is great We say that there is no separation of powers in Ecuador: Correa controls all the courts, the media, the legislature- all facets of life. This stems from Correa's presidential Mandate/Decree 1 which gifts Correa with full powers to be Ecuador's sole decision maker- a dictator by law.

The USA pretends that it is great to have a dictator for life as Correa in some nations as long as the main donor of the US Democratic Party, George Soros is happy- happy that his drug legalizing cartel support efforts move forward and happy that the USA enjoys the deteriorating effects of criminal cartels, even as millions of Ecuadoreans have fled to the USA and Spain seeking stability which they will never have inside Ecuador which is lawless and hopeless. We say this because the US Democrats spend millions- tens and tens of millions- of US dollars to build a machine of lies about Correa's Ecuador and call this "democracy building." This criminal enterprise is a criminal enterprise because it is dishonest, remains unaccountable and hides behind false reporting to the USA. This all needs to stop. Chevron Texaco has walked in backwards to a mighty machine of dishonesty and has no clue how to get out. There is a winnable solution for Chevron: state the facts- all the facts and move forward.

Fausta notes that Correa is doing this for money, to divert his nation from his problems with the FARC and his own presidential failures. Correa presents himself as a man of the people. Robertson is wrong to call the government of Ecuador [GOE] a simple populist problem: it is not at all. This is a criminal cartel. Robertson calls Correa's fake suit against Texaco as good politics- intellectually dishonest but good politics. We disagree- we say it is horrible politics and can only be sustained by more and more lies. Robertson should amend his claim and call this for what it is: state sponsored extortion racketeering. As such, Chevron Texaco must act on the facts and move this entire matter as such. But....they stupidly keep wasting hundreds of millions of dollars with the ridiculous pretense that somehow, magically, there will be justice tonight for Chevron and all Ecuadoreans. Magic is wonderful except when it replaces law and order. There is no magic in Ecuador left- only the crime of state cartel lawlessness and its offspring.

Texaco commenced a deal based on charity during the time of Sixto to remediate some open wells- Texaco spent over $40 million in repairs that they were not required to do. This was essentially a public relations expenditure but made real as Texaco actually agreed to work hand in hand with PetroEcuador's pre selected remediation contractors. This was accomplished in response to the Kennedy family's wild eyed claims that Texaco had ruined the Amazon basin. No one in Ecuador stood against these Clinton-era liars then or now, especially not the family of Alvaro Noboa who still pretends that the Kennedy family are their friends when nothing could be further from the truth.  Ecuador spent zero on environmental restoration and kept pouring in squatters and more wastes. While the sole economic advisor to the government of Ecuador, Soros's own Jeffrey Sachs was working hand in hand with the utterly dishonest Ivonne Baki and then president Mahuad to shut down Ecuador's economy, Ecuador was without any functional economy.  The entire oil zone- the precise plantation was left, under Mahuad and Baki, with new and old messes made and unremediated by Petroecuador. Chevron is correct to accurately test the region where they are blamed- noting that the human and animal wastes that has soured the local system which they blame on Texaco.

Today, Baki, who is a consummate liar, enjoys a self promoting propaganda piece about herself in a Washington newspaper.

Ivonne Baki is a self made creature to sell her husband's Muslim banking business. She may call herself an actor of the art of the possible but we call her impossibly ignorant, dishonest and manipulative. Her happy string of lies here forgets to report that she hosted Yassir Arafat as a guest of the people of Ecuador to further Hamas and Hezbollah's special...banking relationships. She forgets to report her support for Stanford's fraudulent investor activities in Ecuador. She forgets to report that even Donald Trump considers her a fraud. But the United Nations will welcome her as one of their own- a Soros woman to sell more dishonesty and more fraud...just as she herself engineered during her ridiculous so called free trade manipulations. Baki's team ended up selling out whole chunks of free trade to her closest team of criminals, manipulators and their clients. She is a disgrace and is not even a decent artist. Her singular role as a so called peace maker was to pimp for the unhelpful Luigi Einaudi, Peter Romero and her Harvard-based consultants to GET TO YES! on the Peru-Ecuador Border settlement which disgracefully ended up with a tiny spot of memorial land inside Peru for Ecuadoreans to visit while all else was abnegated to lies and disgrace. We do say that peace is of course a worthy goal. The fact is this: by March, 2005 peace was Ecuador's and peace remained- monitored by the USA at the borders for a lot of money. Baki did not bring peace- peace was extant even as Peru's perp Montesinos continued to cover up his vast drug running empire, the source of the military presence in Northern Peru anyway. Baki played in to the cover up and was played by her hyperactive pals who played her as she played Ecuador- in a frenzy of dishonesty. It was in those years that Chevron Texaco was forgotten and ignored even as Baki slipped in and out of Bill Clinton's hallowed hallways claiming to be helpful when indeed she was not. But the perpetrators of this chimera, this fraud against Texaco kept right on -beavering away- for ten years to support and build its massive case of fake facts even as no one stood to stand for the facts. Like a snowball rolling down a mountain, the case rolled on across successive Ecuadorean landscapes unabated. And that massive cess pool of lies has reached gargantuan proportions today- one of the largest claims based on no facts but across Ecuador held as gospel truth to a people so easily seduced by slander. This is not good politics as Robertson calls it- this is evil.

Robertson says that Chevron has mounted a vigorous defense in Ecuador. Of all that was said in the interview- this is what we disagree with. We agree that Chevron has done nothing wrong in Ecuador except to have the stupidest defense lawyers for the last ten years and no way out of the mess they ignored for too long.. Robertson was asked about then US senator Obama's letter of support for Correa, which he ridiculously says he agreed with because he feels this means that Correa should also stay out of the case, which of course will never happen. Robertson irresponsibly said that the White House delivered its 6-09 ATPDEA report which notes the judiciary problems, saying as it does that the judiciary has problems. Problems? Ecuador has no judiciary- no laws, no courts, no justice. Just read the constitution. Read the hundreds of Correa's recent decrees: he runs everything and all justice is gone. Robertson stupidly fails to state the case....as if by acting like a US AID contractor and lying a lot about Ecuador, as is the on going scam, he will assuage Correa in to bending Correa's own laws to Chevron's advantage. As if. As if playing the art of extortion and manipulation will magically bring justice upon them. We find this a road to avoid.

Robertson also forgets to say that the case that was moved from the USA in the Clinton years to Ecuador is in no way the same case that exists today. The motion under Forum Non Conveniens no longer applies and must be vacated. The case today is entirely different than the one brought to Ecuador and the conditions to apply Forum Non Conveniens no longer exist, unless of course one enjoys racking up huge legal fees as both plaintiff and defense counsel are doing as their own nasty cash cow. Try explaining that to Chervron's share holders. Try explaining why Chevron is afraid of the US Department of State and his thousands of liars currently lying about Correa's Ecuador. Try telling your real employers- the shareholders- that Chevron failed itself and them because...it suffers an extortion from Obama and Correa to silence its facts in order to grow these ALBA cartels today. Try it. The phony case of Correa and Obama's pal Donziger should and must be dismissed and we have said this before. It does not belong in Ecuador. It belongs no where.  Robertson says the USA is watching the lawsuit and that the USA should not intervene.  In this he sets a bad precedent and reflects a very parochial mind set- he is also quite wrong. Robertson should explain to his shareholders precisely what Obama means when he says he is watching Correa and Ecuador... and why this is helping Chevron defend itself. We promise you- even Roger Noriega in his vanity "watched" the Chevron case even as he took Ecuadorean money from Correa to lie a lot about Correa- to his disgrace. Watching a giant racket is like bird watching- you may have some prurient interest in it but it is not justice and is not helpful. Obama's "watching" Correa is more like watching a porn movie in slow motion. That is no substitute for justice although Ivonne Baki would opine that such brings "peace." There is no peace when Correa's Cuban-KGB spies are running a cartel nation. The only benefit from knowing these manipulators of such a plan is the medical need to take penicillin for life.

The key statement in this radio show is that Robertson says they are losing hope in Ecuador. That is the more important statement of all. Obama will keep an eye on this? Really? Ivonne and Correa tell us that they have hope too. They hope that Correa and Obama's chum Donziger will replace stolen Central Bank monies with funds extorted from Chevron. If that is hope, we  want no part of it even as Obama gifts LuLa of Brazil with $10 billion in pledged packages to seed his PetroBras speculative bubble, viz Soros's own Armenia Fraga. Latin state oil movements in all ways is dishonest today- unaccountable, opaque and fully corrupt.

Ecuadorean media once reported that the sole Correa kangaroo judge hearing this $30 billion claim is barely literate himself and is a recent convert through Hezbollah in this FARC zone to fundamentalist Islamand is a practitioner of shari'a law through which he adjudicates a gross racket of crime while not even comprehending the legal definition of extortion or racketeering which does not exist in his Hezbollah rule book, removed as if these crimes do not exist. Extortion, money laundering, falsification of Correa's records and racketeering or even terrorism are not defined nor considered as unlawful in Correa's new constitution of 9-08 and no laws defend Ecuadoreans from these crimes. But we are sure that the crack legal teams at the US Department of State, who helped pay for these non-law laws have already told Chevron Texaco and the US Congress this. of course they have because they are obligated to do so. And of course the US Department of State's fact page on Ecuador reveals these facts because it is required to do so under U.S. law. Indeed, it does not say anything honest at all, hiding behind the fake wall of fake diplomacy to build these fake democracies in ALBA called cartels.

Here is Obama's friend Donziger in Ecuador with US AID- Soros and US Speaker Pelosi 's own FARC helper Cong McGovern [D-MA] assisted by the US government to lie some more to Ecuadoreans and lie to themselves...and lie to the US people while spending US tax dollars to lie about Chevron:

Would you gift a $30 billion claim to these....liars? These are Correa's partners in extortion, deceit and propaganda.

Fausta correctly says that Ecuador is a fake democracy. Robertson says they have avenues for appeal inside Ecuador. He says they are managing expectations. He says they have BIT options, which were from the Duran-Ballen time and are now not in play. The Obama ATPDEA Report of 6-09 forgets to ammend itself while telling the US Congress that Obama is "watching." His watchfulness ignores the fact that no sooner did Ron Kirk's USTR reveal the crassly dishonest Obama-ATPDEA Report that Correa ripped up the BIT treaty with the USA. Of course he did- he has been saying for years that he will. Correa's own ALBA constitution says that this will be the case and indeed it is. There is no reason whatsoever for the USA to throw money down the corrupt rat hole that is Correa's crime spree except that the USA's own Soros supporters for drug crimes and dirty money movements think that lawlessness in the Andes will aid and enable their favorite entities previously called the FARC but now known by dozens of sub comandantes of crime, all sheltered inside Ecuador.

Robertson notes the fraudulent cases against DOLE. he is right to do so but once again he is naively optimistic because he hopes that somehow US justice will prevail as he pretends that Correa's courts will consider US court rulings. This reversal of justice in Ecuador cares nothing anyway about the facts- nothing at all. But Robertson naively forgets to consider what transpires when a nation based on rule of law suffers its own citizens against a region that has no rule of law even as today its own people work behind the scenes to grow this lawlessness, pretending to sell rule of law reforms while actually enabling cartel growth. This is a fraud and must stop.

Robertson is correct to report the facts as he sees them. Tragically, no one involved with Chevron Texaco grasps the severity of the direct and conferred blessings which Chevron and its employees have and hold: they can speak in the USA openly, any time and anywhere. That is because all U.S. laws protect and defend liberty, unlike Correa's Ecuador where a common citizen is hauled off to jail or worse, for speaking any facts. What is essential to grasp is that no one- no one- has nor holds any guaranteed liberties in Ecuador any more. We do not expect Robertson to understand this salient and essential feature but someone out of the thousands of Chevron employees somewhere must understand this and be honest. To date, only a slight flutter of the stunningly corrupt landscape is attended to by Chevron, to their disgrace. Robertson was able to speak the truth in the USA about Ecuador while no Ecuadorean is permitted to speak the truth about Ecuador or anything else. As such, Chevron Texaco will have no justice inside Ecuador, a Russo-Iranian proxy nation, whatsoever.

Consider –read here- this insightful tome which reminds us why Ecuadorean society collapsed in three years under Correa: envy. A whole nation raised to be envious of each other and to reject all individuality and talents, looking and decrying any who had or held a commitment to honor. They are gone now- wiped out by self-replicating, charmless, irresponsible, inferior, low lying manipulators whose commitment to nothing has brought Ecuador.... even less.

ECrisis states again- we commend truth tellers such as Robertson and Fausta. Robertson has no clue how serious these issues remain...and he, and his company, should self-educate instead of acting like Ecuadoreans, wallowing in their self created ignorance and vapidity.

We commend the USA for still having and holding some open media and free speech. We understand how terribly hard it is for Chevron Texaco to undo what Obama and his Soros minions have done by creating a horrifying machine of corruption in the Andes while proclaiming their efforts to clean this up. Not unlike declaring Zelaya of Honduras the legal president of Honduras based on no facts, Obama presents a face of Ecuador based on no facts and still pours tens and tens of millions down that rat hole to build Correa's cartel. This needs to stop. Robertson pretends that Obama's ATPDEA statement about Ecuador spoke the truth when it did not. Obama's statement on Ecuador irresponsibly gave some half truths with data missing, no facts and whole chunks of pure baloney. This was no advantage for Chevron- only more status quo. To really protect and defend Americans, which is Obama's only task, he too should start with the facts- all the facts and not some half-baked partial trade analysis which contained no data and no attribution, probably because it reads like a cut and paste from one of Correa's own paid propagandists in Washington, DC who concurrently also work for the Obama-Chavez-Soros teams as well as the US Department of State. Why would the USA lift a previous text from Correa's liars and call it their own? The answer lies with accreditation, transparency and accountability- still missing in this wonderland called Ecuador, now enabled by paid provocateurs and liars. This is not diplomacy and it is not helpful.
 
There is no justice in Ecuador under Correa and none will have it- no Chevron and not anyone else. Chevron should have had and held a care for the entire landscape of deteriorated essentials but it did not. Chevron believed that its crack team of vapid counsel would outsmart Correa, Chavez and the cartel they work for, also called funded through the Russo-Iranian nexus and enabled by the USA's unique minions of Soros, also called the hard left of nascent new age communists- whatever they are. They are cartel racket enablers. Like Christian principles, justice does not exist when manipulated by uneducated and vapid players. Justice is a life long commitment.

We are long past wishing Chevron Texaco good luck in Ecuador. That company has been victimized by a mighty political cartel- a machine of dishonesty in the USA and in Ecuador. Chevron is no longer a victim. Chevron can and must follow the Donziger money trail and must follow the money trail that feeds the thousands of paid liars who protect and defend Correa's cartel machine. Chevron has the tools and the smarts, if they use them, to get out of this self perpetuating extortion racket regardless of the lies that Correa, Chavez and Barack Hussein Obama perpetuate about Ecuador. Chevron knows what to do and the sooner they do this, the sooner their real bosses- their shareholders- can sleep at night. And maybe, just maybe, some Ecuadoreans can sleep better at night too. Maybe.
 
We do have a correction to Correa's past announcements. He now wants you to know he is not going to Havana for a family vacation with all the other perverts who go to Cuba for cheap sex "vacations" which is why people go to Cuba.  Correa now says he goes for a knee joint health matter- a matter that Ecuadorean orthopedists could attend to if asked or if real. Correa is a devotee of Castro's communism. He has so said all his dishonest life. Correa has a lot of problems and they all begin and end with his addiction to dishonesty and manipulative living. He is, after all, his mother's boy. We hear she is in California.
 
As for Chevron Texaco, in their Ecuadorean fashion, the company delivered nothing and has fostered no support among defenders of liberty, struggling in Ecuador because its own were arrogant idiots. This has cost Chevron dearly. No man, no company stands long as an island. Chevron Texaco could have and should have stood shoulder to shoulder with truth tellers. Instead they took advice from their own ridiculous counsel and the US Department of State-Sorosites and ran away, leaving Chevron to ascertain that... they come for them next. And indeed they have- $30 billion worth in racketeering crimes.
 
We are delighted that Chevron Texaco has presented the facts about Correa's Ecuador in its self defense. It is terrible that they even had to do this because Ecuador refuses to even maintain a facade of an independant state oil compnay, which like PdVSA is Correa's own cash cow. Ecuador deserves and must perform an independent forensic audit on Petroecuador... and Correa's entire budgets. Unless and until Ecuador has and holds the facts, it does not. All Ecuador holds in its claim is a string of lies and propaganda. That is no way to be a partner to anything and cedes to right for Correa to enjoin Donzier-Obama in lying about Chevron Texaco.
