What Ecuador Will Not Tell You About Correa’s Racket Against U.S. Companies, Especially Chevron

June 25, 2010 ECrisis once again finds this column today expressing our gratitude to Chevron Texaco for telling the facts and revealing what we all know, but no Ecuadorean is man enough to say and certainly not one legislator or Ecuadorean lawyer is man enough to say….that Rafael Correa’s extortion racket government is disgustingly corrupt. We cannot find one false word in the following article except to decry Chevron for waiting so long and depending on the world’s stupidest advice- which we hear all the time from Chavistas and citizens of Ecuador and Venezuela that if one ignores the facts/never seek the facts and pretends that all is wonderful, Correa will not hurt you, throw you in jail or extort from you and your family. This is moral and ethical bribery and Ecuadoreans are so easily seduced by this for none have nor hold legal competence, ethical prowess of moral backbone. It is the cancer that has eaten Ecuador alive. Chevron is late- very late to the realm of fact telling about what happens inside Ecuador. This is inexcusable and yet we commend their latent integrity to so do while all around them are paid liars, pervs, perps, propagandists and predestined miscreants. Hillary Clinton and Barack Obama call this wonderful. Chevron did not pollute Ecuador: Ecuador by word and deed pollutes Ecuador and has created a nation totally discredited to any legitimate actor, except Mrs Clinton, Chavez and Castro….the later two perhaps may know better. Even the FARC do not trust the self enriching family of Correa and have a long history of not trusting la famille Correa which is probably why the KGB-Shining Path doffed la padre Correa as he was one of their own and as was their pattern decades ago to prevent his singing any more. We call it a killer cancer eating the land alive like locusts. Only criminals do business with Correa’s Ecuador. Hillary Clinton should have known this.

The following piece out of San Francisco is reprinted from Chevron’s own web site. We hope you review this. If you have facts to disprove the points here, it appears that you can easily write Chevron with your facts.

This new blog post on the San Francisco Chronicle’s website discusses Steven Donziger’s role in the trial in Ecuador and the fabricated “independent court expert” report:

In the never-ending Chevron Ecuador legal battle, Lawyer Steven Donziger (the head of a decade-long battle to extort billions from Chevron for environmental damage caused by the Ecuador-owned Petroecuador and Ecuador President Rafael Correa’s policy of allowing oil production in the Amazon, while having kicked out American oil companies) and the Amazon Watch organization yesterday called for additional damages against Chevron in Ecuador, citing alleged sabotage of the court proceedings by Chevron.

That’s a joke on several fronts. First, understand that this effort is nothing more than Steve Donziger’s ticket to billions, as this space stated in this video.

It’s sad, that Donziger is accusing Chevron of somehow tampering with the Ecuadorian court system when, in fact, it’s Donziger and his colleagues who have been trying to manipulate the already corrupt court system in Ecuador.

What’s really bothersome about this goes back to something that has its roots for this blogger at the Department of City and Regional Planning at The University of California at Berkeley. It was there, at what we lovingly call “DCRP” (and to which I owe a donation), that some of my fellow students rubber-stamped the economic development actions of governments in third-world countries.

Not to get too much off the point, but government’s stealing petrodollars that could help the poor, and the overuse of narcodollars to line political pockets was seldom a focus. It was the classic “big company bad”, “third world country good” ethic. An idea that I totally hated because it’s simplistic; in this business the lines of good and bad are not so clear.

The people you think are “good” are some of the first ones in the Ecuador case, to shoot an arrow into your back.  It’s a known fact that Ecuador’s poor in the Amazon are hostile to outsiders even from their own country.  It’s also a known fact that Ecuador’s politics and court system are as dirty as the oil it produces.

At the time I was there, some at DCRP presented a “small group think” that escaped a hard look at corruption and never really solved problems for countries like Ecuador. Now, Ecuador’s government is allowed to get away with ignoring its poor without criticism. Ask Amazon Watch why it doesn’t sue Ecuador itself?  The answer is simple: because they’re in partnership with each other.

Donziger’s credibility is lacking

Earlier this year, evidence submitted by Donziger and his team in Ecuador was repudiated by Charles W. Calmbacher, the very expert that Donziger and the plaintiffs hired to make a report.

Calmbacher, under oath in a deposition you can download here, said the evidence submitted by Donziger and the Amazon Defense Coalition was fraudulent and was not written by him.

All of which leads to one conclusion considering Wednesday’s news: Steven Donziger, Amazon Watch and the Amazon Defense Coalition, are trying to divert attention from their own court fixing attempts, imply that American Chevron has done something wrong in Ecuador, and collect billions that would go to the Ecuadorian government, and to Donziger, and not the people Donziger claims to represent.

Ecuador’s own lawyer Washington Pesantez, who’s title is Ecuador’s Prosecutor General, has already said it would get 90 percent of the $27 billion or $16 billion or whatever number Donziger’s managed to conjure up of late.

That, folks, makes Ecuador a party to Steven Donziger’s own lawsuit and calls into question all this jazz about helping the indigenous people of Ecuador.  But even with the information presented, Donziger and Amazon Watch press on with their claims.

Time is not on their side. There’s still the issue of evidence of involvement in the Chevron Ecuador case by President Correa’s own political party.

The New York Times ran an article on the bribery scandal involving then Chevron Ecuador case Judge Nunez and recordings that point right to President Correa’s sister Pierina Correa as being in line to be approached about the bribe. This is what the Times reported:

In the same meeting, Mr. Garci­a told Mr. Borja how to approach Ms. Correa, the president’s sister, about the bribe. “Tell Pierina clearly, ‘Madam Pierina, what we came to do beyond anything else is to participate, participate in the remediation. That’s why I want to make you part of this.’”

Mr. Correa’s party was to receive a million in the bribe effort.

Now, collect the dots here: we have Ecuador’s own lawyer Washington Pesantez stating Ecuador will get 90 percent of the damage award, and we have allegations and evidence pointing to President Correa’s own political party as getting some of that same damage award. This lawsuit is designed to do nothing more than make Steven Donziger rich and Ecuador’s rich, richer, while Petroecuador continues to mess up its own country’s environment.

ECrisis reads your comments. We know how much you enjoy telling us that life is best lived being dumb and helping Correa steal from other people. Truly we do not want to hear this any more. Ecuadoreans pretend that being stupid will help Ecuador steal more money for more Correa hand outs and bribes which will line their pockets. A nation of citizens being party to fraud and theft- knowingly- reveals a far worse problem. In fact, it is a crime. If you enjoy being known as a nation of criminals, go ahead. But we promise that you will lose in the end and soon enough there will be no one left to steal from, scam,.extort or rob….not even Hillary Clinton in her ridiculous Chavez-Marxist unity suit with matching tote bag.

ECrisis does fully agree with the above article. Chevron is being sued by a group of Americans backed and partnered with the government of Ecuador. This is an entirely different case from the case originally filed in New York which was relocated to Ecuador. There is not one valid reason for this current case to be heard in Lago Agrio. Why it remains is a mystery to legal analysts. What one can only conclude is that Chevron has been lied to by its own greedy and incompetent legal team of Ecuadorean lawyers who have no concept of forum non conveniens which does apply nunc pro tunc and must be used. Chevron’s crack legal team of idiots are afraid to tell the facts about what Correa is doing in hopes that Correa will be nice. Correa will not be nice and is not a candidate for rehab. Correa is a state sponsor of terror and a drug king pin. There is no valid reason  for this lawsuit to be heard in Ecuador, especially in Sucumbios province now over run not by Colombian refugees but by global vermin- criminals from every  cartel known to God” rapists, weapons and human and drug runners, Marxist-Hezbollah- creepy religious zealots and kidnappers. Correa has created a crime zone free for all in Sucumbios which he does by incredulously blaming Chevron for  what he has done for 4 years which is…. a lot. Sucumbios was not a Texaco dumping ground: it is Correa’s dumping ground for tens of thousands of criminals and terrorists.

But wait! Here comes Chavista Gallegos on June 17, 2010 to lie a lot on a letter to the Miami Herald’s editor: “I am happy to report that relations between the United States and Ecuador have reached a new maturity based on mutual respect.”

ECrisis notes that while Gallegos is “happy to report” that Ecuador continues to pay lots of money to Hamas, Hezbollah, Aristide, Soros’s own USA Democratic Party, biased Hard Left shills like DAILYKOS, and the Sandinistas’ favorite company of liars called Fenton Communications to shell out pap like this from the name of Correa and Gallegos, we consider anything Gallegos says as a cause to review his canard…paid lies.

Gallegos at first blush wants to refute the remarkably vapid Roger Noriega who lied his way to fame and fortune. He also worked for Correa to craft harm against Occidental. But Noriega was correct to question what Hillary was doing with Correa. Noriega himself never did and approved tens of millions of US dollars to back the Correa ship of state. Gallegos wants to tell us that Tom Shannon, now in Brazil, started the Correa-USA dialogue. No nation that is not considered a pariah state does not have some form of dialogue with the USA and even North Korea gets more than its share of attention. Nonetheless, Shannon did truly hold dialogue with Correa and Noriega knew this and soothed over this. Shannon had dialogue with Correa because Shannon refused, as Hillary does still yet and Noriega before him did do, to have or hold any facts about the Cuban-ALBA proxy state for cartels created and run by Rafael Correa. Tom Shannon refused to have or hold any facts about Correa. Hillary Clinton has sailed forth- Marxist red pant suit and all- in this dishonest diplomacy. Gallegos applauds the USA’s refusal to have or hold any facts about Ecuador- he considers this praiseworthy.

The Noriega plan, followed by the discredited by his own actions Shannon and now by Allende-loving Valenzuela to know nothing at all about Ecuador to better praise Ecuador is a complete disaster and makes them look as stupid and incompetent as can be. And they are. Correa is a train of evil. He has left the station. He has gamed all that he touches. Gallegos just wants to help you stay stupid- as stupid as Noriega, Shannon and Clinton in a world where facts are easy enough to hold and no man should be an ignorant fool.

It is of course appalling the Noriega, Shannon and Clinton-Valenzuela [boosted by the now disgraced Peter Romero and Hillary’s old team from Glover Park]  intentionally and purposefully have not one scrap of a fact based Dossier on Ecuador. This is not unlike having a fake witch doctor gift one- for a fee- with a fake prescription for marijuana, also encouraged by George Soros, for fake medicinal purposes just because one whines a lot and pays a fee. One cannot have judgment when relying on witch doctors and fake, non existent analysis.  All this to let Cuban-Marxist proxy Correa game law and order [heralded by US AID support idiots], currently enjoined with the Soros cap and trade scam as a good foot soldier for the bring-down of global markets? And who can forget Correa and Hillary’s support for millions of criminals living in sanctuary in U.S. federal lands while no one else can go in to the US parks? Hillary and Correa think this is great and that no law enforcement by anyone should impede the growth of these terror activists inside the USA, sometimes called US parks inside Arizona. Hillary thinks that is a good thing? Mrs. Clinton has long been a mouth organ for Soros and she has not changed one bit. But she should- she is a disgrace and a pretty obvious one at that. Correa meanwhile probably wants to know where she gets her mascara.

Gallegos tells us, through his paid activist public relations propaganda team, that the US-Ecuadorean relationship is fabulous: pleasant-friends. Friends like these are a discredit to us all. Gallegos says this is “effective.” Yes it is very effective: for criminals which Gallegos sells, currently extorting Americans and Hillary just enables, as do almost all Ecuadoreans. That is not diplomacy and it is definitely not state craft. It is criminal.
